RENT AGREEMENT

This Agreement is made at ____________, District ____________, between Mr. S/o, hereinafter referred to as the “LESSOR/OWNER” of the one part;

AND

Mr. S/o, hereinafter referred to as the “LESSEE/TENANT” of the other part.

In consideration of the rent hereinafter reserved and all the covenants and conditions hereinafter contained to be observed and performed on the part of the Lessee, the Lessor hereby lets out the premises situated at:

(hereinafter referred to as the “Premises”).

The word “Lessor” and “Lessee” shall, unless repugnant to the context, include their respective legal heirs, representatives, successors, authorized agents and permitted assigns.

THE LESSEE HEREBY COVENANTS WITH THE LESSOR AS FOLLOWS:

That this Agreement shall commence from ____________ and shall remain valid for a period of ____________ months.
That the Lessee shall pay to the Lessor a monthly rent of ₹____________ (Rupees ____________ Only), including/excluding maintenance, payable in advance on or before the ____________ day of every calendar month. Any future increase in maintenance charges shall be paid by the ____________ Party.
That the Lessee has paid a sum of ₹____________ (Rupees ____________ Only) as an interest-free security deposit, which shall be refundable upon expiry/termination of the Agreement and handing over of vacant possession, after adjustment of any outstanding dues, damages or other lawful charges.
That the rent shall be exclusive of electricity, water and other utility charges. The Lessee shall pay such charges as applicable and shall provide the relevant payment receipts to the Lessor, wherever required.
That if the Lessee remains absent from the town at the expiry of the Agreement, leaves the premises without informing the Lessor, or fails to pay outstanding rent/dues, the Lessor shall be entitled to take appropriate lawful action in accordance with applicable law.
That the Lessor has let out the said premises to the Lessee for ____________ purpose, and the Lessee shall use the premises only for the permitted purpose and shall comply with all applicable rules and regulations.
That the Lessee shall not carry out any permanent or temporary structural addition, alteration or modification to the building, layout, fittings or fixtures without the prior written consent of the Lessor.
That either the Lessee or the Lessor shall be entitled to terminate this Agreement during the initial or renewed term by serving ____________ month's prior written notice to the other Party.
That any extension/renewal of the Agreement shall be subject to the mutual consent of the Parties and shall be made on such fresh terms and conditions as may be mutually agreed.
That the Lessor shall carry out major structural repairs, including ____________, at his/her own cost within a reasonable time after being notified by the Lessee, except where such damage is caused by the Lessee's negligence or misuse.
That the premises have been let out for Commercial / Residential / Office / Other ____________ purposes only, and the Lessee shall not change the use of the premises without the prior written consent of the Lessor and necessary legal permissions.
That upon renewal/extension of the Agreement, the rent shall be increased by ____________% or at the prevailing market rate, as mutually agreed between the Parties.
That the Lessor shall not be responsible for any illegal activity, unlawful act, violation of law or regulatory breach committed by the Lessee, his/her employees, agents, visitors or representatives.
That if the Lessee vacates the premises before completion of ____________ months from the commencement date, the security deposit shall not be refunded / shall be refunded after adjustment, as mutually agreed by the Parties and subject to applicable law.
That the premises, fixtures, fittings and other facilities are being handed over to the Lessee in good working condition. The Lessee shall maintain the same in good and tenantable condition throughout the tenancy.
That the Lessee shall take due care of all electrical fittings, furniture, fixtures, appliances and other articles provided with the premises. Any damage caused due to negligence, misuse or carelessness of the Lessee shall be repaired/replaced at the Lessee's cost or may be deducted from the security deposit.
That the Lessee shall not sub-let, assign, transfer or otherwise give possession of the premises or any part thereof to any third party without the prior written consent of the Lessor.
That the Lessee shall not store any illegal, hazardous, inflammable, explosive or prohibited material in the premises.
That the Lessee shall keep the premises clean and shall not cause any nuisance, disturbance or inconvenience to the neighbours, building occupants or surrounding area.
That upon expiry or termination of this Agreement, the Lessee shall hand over peaceful and vacant possession of the premises to the Lessor along with all keys, fixtures, furniture and other items belonging to the Lessor.
That any dues towards rent, electricity, water, maintenance, damages or other charges shall be cleared by the Lessee before handing over vacant possession.
That the Lessee shall comply with all applicable laws, municipal rules, society/building rules and other regulations relating to the use and occupation of the premises.
That any amendment or modification to this Agreement shall be valid only when made in writing and accepted by both Parties.
That in case of any dispute arising out of this Agreement, the Parties shall first attempt to resolve the matter amicably. Failing such resolution, the matter shall be subject to the jurisdiction of the competent courts at ____________.
That both Parties have read and understood the contents of this Agreement and have executed the same voluntarily and with their free consent.
